Terms of Service
The written terms that govern every production and distribution engagement with the Studio — scope, payment, usage rights and governing law.
1. Who these terms cover
These Terms of Service govern all production and distribution engagements between [[LEGAL_ENTITY_NAME]], trading as Corporate Executive Studios (“the Studio”, “we”, “us”), and the individual or organisation booking the work (“the Client”, “you”). Placing a deposit constitutes acceptance of these terms.
2. Scope of work
Every engagement is defined by a written scope issued after a discovery call. The scope states the deliverable list, shoot dates, locations, crew, delivery formats, the total fee in USD, and the delivery window. Work outside that written scope is a change order and is quoted separately before it begins.
- Verbal requests are not part of the scope until confirmed in writing.
- Additional shoot days, locations, talent, licensing or travel are billed at the rates stated in the scope.
- Two revision rounds are included on production engagements. Further rounds are billed hourly at the rate stated in the scope.
3. Pricing and payment terms
Published price ranges are: Corporate Videos $2,500 – $25,000; Commercials $500 – $10,000; Podcasting $500 – $5,000; Digital Billboards $500 – $10,000; Streaming Distribution $1,000 – $25,000; Cable Distribution $1,000 – $25,000. All amounts are in United States dollars.
- 50% deposit is due to book a date and start the work.
- 50% balance is due on delivery, before final master files are released.
- Invoices are payable on receipt unless the scope states otherwise. Overdue balances may pause delivery.
- Card payments are processed by our payment processor; we do not store card numbers.
All prices, locations, dates, times, and services are subject to availability. Custom scopes are quoted after a discovery call. All prices are in USD.
4. Client responsibilities
- Provide brand assets, approvals and site access on the dates agreed in the scope.
- Secure permissions for any location, trademark, likeness, product or music you supply to us.
- Nominate a single approver for revision rounds. Delays in approval move the delivery date by the same number of business days.
5. Intellectual property and usage rights
You retain ownership of all brand materials, marks and footage you supply. On receipt of final payment, we assign to you the usage rights stated in the scope for the finished deliverables — typically a perpetual, worldwide licence for the media channels listed.
- Project files, raw footage, session files and unused takes remain our property unless the scope says otherwise. Raw media can be purchased as an add-on.
- Third-party licences (music, stock, fonts, talent) carry their own terms and durations, which are stated in the scope.
- We may show finished work in our own portfolio and reel unless you request otherwise in writing before delivery.
6. Distribution engagements
For Streaming and Cable Distribution we act as your agent in preparing, submitting and placing finished work. Acceptance, scheduling and carriage decisions rest with the platform or network. We do not guarantee acceptance, placement position, audience size or commercial outcome.
7. Cancellation and refunds
Cancellations and refunds are governed by our Refund & Cancellation Policy, which forms part of these terms. Delivery windows and formats are set out in the Delivery & Fulfillment Policy.
8. Confidentiality
Each party will keep the other’s non-public business information confidential and use it only to perform the engagement. We will sign your standard non-disclosure agreement on request.
9. Limitation of liability
To the fullest extent permitted by law, our total liability arising from an engagement is limited to the fees actually paid to us for that engagement. We are not liable for indirect, incidental or consequential loss, including lost profits or lost business opportunity. Nothing in these terms limits liability for fraud, wilful misconduct, or anything that cannot be limited by law.
10. Force majeure
Neither party is liable for delay caused by events outside reasonable control, including severe weather, illness, strike, power or network failure, government action, or loss of location access. Where a shoot is affected, we will offer the earliest available replacement date rather than a refund.
11. Governing law
These terms are governed by the laws of the State of [[STATE]], United States, without regard to conflict-of-law rules. The courts located in [[CITY]], [[STATE]] have exclusive jurisdiction over any dispute. The parties will attempt good-faith resolution by email and phone before commencing proceedings.
12. Changes to these terms
We may update these terms. The version in force for your engagement is the version published on the date your deposit is received. Material changes are posted on this page with a revised date.
